Lotto winnings in Spain has been subjecting a progressive income tax to the organizers of lotteries abroad, then domestically accumulated winnings are exempted for taxes.
The European Commission told that, this discriminative act of taxing is prohibited by the European Union because it limits the freedom in providing services.
Spain reasoned out that the exemption on their lotto organizations because of their trait of being charitable, and this is not based on the place of origin.
The European commission is insisting that exempting is discriminatory, this treatment is not open to the organizations of European Union with the same nature.
The rules in Spain are that the income earned from a contest locally prices will be subjected to tax.
